Consent to Sexual Activity

A conviction for sexual assault under s. 271(1) of the Criminal Code requires proof beyond a reasonable doubt of the actus reus and the mens rea of the offence .  The Actus Reus of Sexual Assault To establish the actus reus of sexual assault, the Crown must prove three elements: (i)            touching; (ii)          the sexual nature of the contact; and (iii)         the absence of consent.  See R. v.
