Purchasing a Gun does not Constitute Weapons Trafficking

The offence of weapons trafficking is created by s. 99 of the Criminal Code. It provides that an unauthorized transfer of a firearm is an offence. "Transfer” is defined by s. 84(1) of the Criminal Code as meaning to “sell, provide, barter, give, lend, rent, sent, transport, ship, distribute or deliver”.

However, agreeing to purchase a firearm does not constitute a “transfer” of the firearm.

Arrested at Home: Feeney Warrants

At common law, where the police had reasonable grounds to arrest a suspect and reasonable grounds to believe a suspect was in a private dwelling-house, they were entitled to enter and arrest the suspect, with or without an arrest warrant, if proper announcement was made. See R. v. Landry , 1986 CanLII 48 (SCC), [1986] 1 S.C.R. 145 , and Eccles v. Bourque et al. , 1974 CanLII 191 (SCC), [1975] 2 S.C.R. 739 ). However, in the 1997 decision of R. v. Police Powers: Random Vehicle Stops

Random Vehicle Stops under the HTA The Highway Traffic Act of Ontario (specifically, section 216(1)) of the Act) allows a police officer to stop a motor vehicle even in the absence of a reasonable suspicion of an offence having been committed providing it is done for the purpose of general traffic regulation such as checking for a valid driver’s license and insurance, mechanical fitness of the vehicle and the sobriety of the driver. In short, there is a statutory basis for police to stop vehicles for the purpose of highway regulation and safety, even where the stops are random. Brown v. Durham , at para. 21; R. v.
